Perry asks judge to order he be put on Va. ballot (AP)

RICHMOND, Va. ? Texas Gov. Rick Perry has filed an emergency order in federal court to require Virginia's Board of Elections to place his name on the ballot for the state Republican presidential primary.

Perry failed last week to meet Virginia's requirements that each candidate receive 10,000 signatures of registered voters, with 400 from each of its 11 congressional districts. On Tuesday, he filed a lawsuit against the State Board of Elections and Republican Party of Virginia Chairman Pat Mullins.

On Wednesday, Perry filed an emergency motion in U.S. District Court in Richmond asking for an injunction to get his name on the ballot for the March 6 primary.

Perry claims Virginia's requirements violate his freedoms of speech and association.

Newt Gingrich also came short of the signatures required to be certified.

After a night of decisions, Alexander Gustafsson scored a first-round knockout of MMA veteran Vladimir Matyushenko at UFC 141 on Friday night.

Matyushenko moved in to throw a strike, and ran right into Gustafsson's jab. He was stunned and fell to the ground. Gustafsson threw strikes until the bout was stopped at 2:13.

"I was prepared for three hard rounds, and Matyushenko is a tough guy, but I got the knockout," Gustaffson said after the bout. "It was a good punch. It was my day today."

Gustafsson has been on a tear since losing to Phil Davis early in 2010. He has four straight wins and a record of 13-1, proving himself as a prospect to watch in the UFC's light heavyweight division.

Weather deserves medal for clean air during 2008 Olympics

New research suggests that China's impressive feat of cutting Beijing's pollution up to 50 percent for the 2008 Summer Olympics had some help from Mother Nature. Rain just at the beginning and wind during the Olympics likely contributed about half of the effort needed to clean up the skies, scientists found. The results also suggest emission controls need to be more widely implemented than in 2008 if pollution levels are to be reduced permanently.

Reporting their findings December 12 in the journal Atmospheric Chemistry and Physics, co-author atmospheric chemist Xiaohong Liu at the Department of Energy's Pacific Northwest National laboratory said, "In addition to the emission controls, the weather was very important in reducing pollution. You can see the rain washing pollution out of the sky and wind transporting it away from the area."

Liu and colleague Chun Zhao at PNNL and at the Chinese Academy of Sciences in Beijing took advantage of the emission controls China put into play before and during the August Olympics to study the relative contributions of both planning and nature. Chinese officials restricted driving, temporarily halted pollution-producing manufacturing and power plants, and even relocated heavy polluting industries in preparation for the games.

To find out if the controls worked as well as people hoped, the researchers modeled the pollution and weather conditions in the area before, during and after the Olympics. They compared the model's results with measured amounts of pollution, which matched well.

Adding up the sources of pollution and the sinks that cleared it out, the team found that emission sources dropped up to a half in the week just before and during the Olympics. And while some pollution got washed out by rain or fell out of the sky, most of it got blown away by wind.

"They got very lucky. There were strong storms right before the Olympics," said Liu.

In addition to rain, wind also helped. Beijing is bordered on the south by urban areas and on the north by mountains, so wind blowing north would carry more pollution into the city. Examining the direction of the wind, the researchers saw that it generally blew south in the time period covering the Olympic period.

"The area we looked at is about 50 miles south. This suggests that emission controls need to be on a regional scale rather than just a local scale," said Liu.

The importance of regional controls meshes well with previous research on 2008 Olympics air quality that focused on nitrogen-based pollutants.

Next, the researchers will be examining the effect of pollution on other weather events and climate change in China. Pollutants are very small particles, and some suspect they might be causing fog to form rather than rain due to numerous pollution particles in China, Liu said.

Families demand Libyan probe into 1992 crash (Reuters)

TRIPOLI (Reuters) ? Families of the victims of a Libyan Airlines plane that collided with a combat jet 19 years ago demanded the new Libyan government reinvestigate the crash that killed 157 people on December 22, 1992.

Muammar Gaddafi's government said at the time the mid air collision, which took place when a Libyan MiG warplane rammed into flight LN1103 as it approached Tripoli, was an accident. The pilots of the combat plane ejected, but none of the airliner's passengers and crew survived.

The families said they grew suspicious when the security forces immediately intervened and buried the bodies in a mass grave in a cemetery close to the crash site.

Felicity Prazak, the widow of Victor Charles Prazak, an oil worker who was aboard the Benghazi-Tripoli flight, believes the collision was not an accident.

"It was like a cover up, they buried them so quickly, they didn't want us to know what happened on this flight," said Prazak as she stood last week near the mass grave site in Sedi al-Saieh, south of Tripoli, along with her son Theo, 23, and daughter Tallena, 22.

"I was not allowed to come to the funeral ... and I struggled for 19 years to find out (what happened)," she said.

The family flew from London to commemorate the crash's 19th anniversary, but they were not alone.

Nearly 200 Libyans surrounded the mass grave which was fenced with metal railings and covered with a cement slab. The names of the victims were engraved on two marble panels at one side of the grave.

Some held framed pictures of the victims, gazing vacantly at the grave site, soaked in rain, as they wept.

"I have been to the grave but it has been on my own 10 years ago with my children," Prazak said. "Now I am here with the unity of the Libyan people and we are fighting to expose what Gaddafi did."

Gaddafi's 42-year dictatorship was brought to an end after a nine-month civil war supported by NATO air strikes. Libyans can now speak openly about Gaddafi's repressive actions.

It was the first time the families of the flight victims were allowed to gather at the site in such numbers and conduct a wreath-laying ceremony.

Most of the victims were Libyans along with 21 Egyptians and 19 from other mostly unspecified nationalities.

Fathia al-Hamali, a Libyan who lost her mother, sister, brother-in-law and niece in the crash, flew with her daughter from Benghazi for the event.

"We want to open this file," she said. "What was the reason? why did they kill innocent people?"

Pakistan: Punjab University Vice-Chancellor urges to prepare for Third World War

world?s circumstances are changing rapidly and there is a possibility of
the rapid start of World War III. A grim bulletin from the Russian
Ministry of Defense issued to Prime Minister Putin and President
Medvedev states that the Chinese President Hu Jintao has agreed in
principle that the only way to stop the West?s aggression led by the United States is through direct and immediate military action. Russian General Nikolai Makarov has said he did not rule out local and regional armed conflicts developing into a large-scale war including nuclear weapons.

The Vice-Chancellor expressed these views while delivering a lecture on ?Pakistan and Global Affairs? at Senate Hall, Old Campus organized by PU College of Information Technology. PUCIT Principal Prof. Dr. Syed Mansoor Sarwar, College of Art & Design Principal Prof. Dr. Rahat Naveed Masud, Oriental College Principal Prof. Dr. Mazhar Moeen, HCBF Principal Prof. Dr. Kh Amjad Saeed and a large number of faculty members of New and Old Campuses were present on the occasion.

The Vice-Chancellor said that according to Chinese Rear Admiral Zang Zhong, China would not hesitate to protect Iran even with a Third World War. He said the US people were making efforts for change and the internet was full of barbaric stories of the torture of US police on ?Occupy Wall Street? movement protestors; all the big cities of the US had become police states. About America, he said the country had passed a ?National Defense Authorization? law on Dec. 8, 2011 under which the whole world had been converted into a prison because US forces had been authorized to arrest any ?suspect? anywhere in the world for an indefinite period.

Prof Kamran stated the members of the US Senate were on the payroll of a group of rich families and US forces and the US President had been working on its agenda. He said that the organized group had been working secretly since 250 years ago to establish ?One World Government.? According to him all the people in and outside the government were their slaves and they can arrest or murder anybody working against their wishes. The Vice-Chancellor said the real history of the US was suppressed and they have also even appointed their people at the universities. He said they recruit young students in their secret agencies and that loyalty and secrecy were the keys to their success.

The Vice-Chancellor said these families have imposed wars on the world and provided debts to governments of both sides at heavy interest and made money. These families, he said, had planned in 1890 that there would be three World Wars and after that the world would be under their control. According to him, banking based on interest had caused the concentration of money in the US. He stated that they (the US) had enhanced capacity of deadly weapons and through inventions and discovery of new knowledge, it was now possible for them to control the minds of the nations.

According to a new research, 96 percent of media were owned by six corporations which did not? allow news or books to be published against them, he said, and stated that the 'war against terrorism' was the biggest fraud and a way to send US forces all over the world and also a way to make the United States a police state and that after 9/11, NATO forces had reached only the oil-and-gas-rich regions. He said the US had started the process of occupying the world by making 9/11 a justification and now the war was being fought to enslave mankind forever -- therefore mankind should keep themselves aware of the plans and tactics of these rich families and prepare against them.

About the Pakistani government, he said it should promote education, start compulsory military training and promote a culture of discipline, because forces only fight with passion when everybody was working honestly. He said the US Federal Reserve Bank was a big monetary fraud and that the names of its A-class shareholders were kept secretly and the secret was considered as a secret of US security, stating it was therefore compulsory to put the nation on the course of education and creation of knowledge. The Vice-Chancellor also cited various quotations of various US and British analysts.

Earlier, Prof Dr Syed Mansoor Sarwar, while briefing about the College, said before the tenure of the sitting Vice-Chancellor, there was only one PhD teacher while now there are nine PhD teachers in the college. Earlier there were 14 MPhil while now there are 26 MPhil teachers. 20 faculty members have been doing PhDs as compared to two, while 12 are gold-medalists. He mentioned that 40 publications have been published in impact-factor journals and said the College started PhD programme in 2009; the college then had only four regular teachers but now there are 52 regular teachers. He said the Day Care Centre has also been established for the children of young faculty members.

Oak Harbor mayor-elect offers kidney to stranger

Oak Harbor Mayor-elect Scott Dudley may be out of the office for a few weeks this summer because he?ll be busy donating one of his kidneys.

And not to a needy family member, but a man from a small suburb of Vancouver, B.C., who he?s never even met. Admittedly, his first six months in office is not the most opportune time for a major surgery, but Dudley said the opportunity came up and he just couldn?t say no.

?It?s something that?s been in the back of my mind for a while,? said Dudley, during a phone interview from Vancouver General Hospital.

Contacted for a separate issue, Dudley only revealed where he was when specifically asked by a Whidbey News-Times reporter. Dudley has been undergoing testing to insure he?s a qualified candidate for months but decided to keep it under wraps while on the campaign trail.

Dudley, a city councilman, won a hard-fought battle for the mayor?s seat with incumbent Jim Slowik this past November. He said he just didn?t feel the need to announce the procedure, which is still not guaranteed to happen, while running for Oak Harbor?s top seat.

?It?s not a situation where I?m doing it for votes,? Dudley said.

Rather, his family has a history of polycystic kidney disease. The genetic disorder results in the formation of cysts that can lead to kidney failure. It claimed both his grandmother and aunt and also afflicted his uncle.

Tests have shown that Dudley does not have the disease, nor is there a chance that he will contract it in the future. However, watching two of his relatives lose their struggle with the illness caused him to want to someday donate one of his own kidneys to someone in need.

That chance came along this spring. Dudley had been planning to go to Haiti on a humanitarian mission in February with his church, Living Word, but the trip was canceled last minute due to political upheavals in the small country.

As assistant governor for the Rotary Club?s district 5050, Dudley instead decided to visit chapters throughout the district including those in British Columbia. The decision would intertwine his fate with Keesha and Philip Rosario, residents of Haney in the district of Maple Ridge.

Philip, a 37-year-old small business owner, had just been diagnosed with polycystic kidney disease. He had no known prior family history with the disorder and only learned he was sick because he hadn?t been able to sleep for three days and begrudgingly went to see a doctor.

?I?m pretty stubborn,? Philip said. ?I hadn?t been to the doctor for a while.?

You can imagine his shock when he and his wife Keesha were told that he had a fatal illness. Even worse, they learned that the waiting time for a kidney from a donor was eight to 10 years.

Keesha, who quickly became an expert on the condition, is a member of her local Rotary Club and was at a meeting and shared the news with other members. Dudley just happened to be sitting at the very same table.

He approached her afterward and Keesha said his face nearly ?turned white? when she told him about the particular kidney disease afflicting Philip. But Dudley turned the tables on her when he said he was already looking to get on an anonymous donor list and would like to give Philip one of his kidneys.

?I?m tearing up just thinking about it,? Keesha said. ?It?s unbelievable how the universe pans out. Through Rotary Club, a lot of amazing things happen.?

Months have since passed, and although Dudley and Philip have yet to meet or even talk by telephone, both have undergone a litany of tests to insure they are compatible matches.

At the time of the interview, Dudley had just underwent a CAT scan and a nuclear renogram, a test in which radionuclides are injected into the blood. They are monitored as they flow through the kidneys to gauge the organ?s health and function.

Dudley joked that he was feeling a little radioactive and wondered if he might set off a few alarms on his way back into the United States. Despite his humor, that?s actually happened, according to Dr. Christopher Nguan.

A urologic surgeon specializing in transplants, Nguan will perform Dudley?s operation. He said there have been cases where patients who have undergone renograms were stopped by border patrol agents for setting off radiation detection devices.

Although the test sounds invasive and uncomfortable, Nguan said it?s really rather benign. Even so, Philip said he is still trying to wrap his head around the idea of someone he?s never met doing so much for him.

?It?s amazing to me that some random stranger ... I have family that wouldn?t do this,? Philip said.

Additional testing is still needed and whether the transplant procedure will move forward is by no means guaranteed. If it does, and Dudley said things look good so far, the surgery would be done sometime in spring or early summer.

But if some unforeseen complication arises and things don?t work out with Philip, Dudley said that doesn?t mean it won?t with someone else. He would remain on the donor list, he said.

?The fact is somebody needs my second kidney more than I do,? Dudley said.

According to Nguan, removing a kidney is a major operation and not without some risk. But Dudley said he?s not worried. Today?s technology --- laptops and cellphones --- will help insure that he doesn?t miss much action at City Hall and he claims to be a fast healer.

?I tend to push the envelope,? Dudley said. ?I bounce back pretty quickly.?

As for Philip, the disease is advancing and not knowing whether the procedure will really move forward is tough. But, with light at the end of the tunnel, he?s looking to the future with renewed hope, thanks to Dudley.

?I just think he?s one of a kind,? Philip said. ?I wish there were more people like him. In my eyes, he?s a hero.?

Detained ex-Filipino leader wants home on New Year (AP)

MANILA, Philippines ? Arrested ex-Philippine President Gloria Macapagal Arroyo has asked a court to allow her to welcome the new year in her upscale residence after spending Christmas in detention.

Judge Jesus Mupas earlier rejected Arroyo's plea to celebrate Christmas and New Year at home citing security reasons. Mupas allowed her family to join her in celebrating the holidays at her hospital suite in the capital.

Lawyer Laurence Arroyo asked Mupas on Monday to reconsider and allow her to be at home on New Year.

Court officer Felda Domingo says Mupas will be on holiday leave until Jan. 6 and may not be able to deal with her plea.

Mupas ordered Arroyo arrested last month for allegedly ordering the rigging of the 2007 senatorial elections. She denies the charge.

Akers sets FG record, 49ers beat Seahawks 19-17

SEATTLE - David Akers kicked his way into the NFL record book and moved the San Francisco 49ers closer to a playoff bye.

Akers made four field goals to give him 42 this season, most in league history, and San Francisco eliminated Seattle from postseason contention by holding off the Seahawks 19-17 on Saturday.

Larry Grant tackled Seattle quarterback Tarvaris Jackson from behind, forcing a fumble that was recovered by Donte Whitner with 1:07 left to seal it.

The NFC West champions remained in position for the No. 2 playoff seed and a first-round bye thanks to an impressive second-half effort on defense that was capped by Grant's hustle play.

Frank Gore had a 4-yard touchdown run on San Francisco's first drive of the second half and Akers hit a 39-yard field goal with 2:57 left to give the 49ers the lead.

Early in the fourth quarter, Akers connected from 44 yards out for his 41st field goal of the season, breaking the NFL mark set by Neil Rackers in 2005 with Arizona.

Akers also hit from 53 and 29 yards. He missed a 52-yard attempt in the first quarter and is 42 for 49 this season.

Marshawn Lynch scored on a 4-yard run with 6:41 remaining to give Seattle (7-8) a 17-16 lead. It was his 11th straight game with a score and the first touchdown rushing allowed by San Francisco (12-3) this season.

Lynch finished with 107 yards on 21 carries, the first back to run for 100 yards against the 49ers since Week 11 of the 2009 season.

San Francisco quarterback Alex Smith protected the ball as he has all season and his biggest throw set up Akers' decisive kick. On second-and-18 from his own 31, Smith threw deep for Michael Crabtree, who got just enough separation from Brandon Browner to haul in the 41-yard reception. The 49ers didn't advance any further, but were in range for Akers to give them the lead.

Smith finished 14 of 26 for 179 yards, while Crabtree had five catches for 85 yards. The bigger contributions came from Gore and his backup, Kendall Hunter. Gore finished with 83 yards rushing, while Hunter added 73 on just 12 carries.

The 49ers had 227 yards of offense in the second half and held Seattle to 72 yards. San Francisco coaches ran through the press box in the final seconds yelling, "Merry Christmas everybody!"

The 49ers could head into next week's regular-season finale at St. Louis with the No. 2 seed locked up if Atlanta wins at New Orleans on Monday night. They are still alive for the No. 1 seed, but would need Green Bay to lose its final two games.

But all San Francisco needs is a win over the lowly Rams to clinch a home playoff game and a weekend of rest.

Meanwhile, the Seahawks' three-game winning streak ended along with their playoff hopes. Seattle already needed an unlikely scenario to get to the postseason thanks to Detroit's win over San Diego on Saturday, but the loss to the 49ers dashed those hopes.

Seattle did make it interesting thanks to its special teams. Heath Farwell blocked Andy Lee's punt and the ball bounced inside the San Francisco 5 with less than 7 minutes remaining.

On the next play, Lynch scooted around the left edge and just inside the pylon, setting off a shower of Skittles flying out of the stands. The candy covered the blue-painted end zone to the point where workers with industrial blowers came out to try and clear the field. They were back minutes later with brooms and pans trying to clean up even more.

The 49ers were the first team in league history to go the first 14 games without allowing a touchdown rushing.

But Smith answered with his deep pass to Crabtree, and Seattle's final chance was thwarted by the only turnover of the game.

Lynch's 6-yard run to start the drive pushed him over the 100-yard mark, making him the first running back to top 100 yards against the 49ers since Ryan Grant did it for Green Bay in Week 11 of 2009. That snapped a streak of 36 straight games for the 49ers without allowing a 100-yard rusher.

Lynch then took a short pass from Jackson for 20 yards to the 45 at the 2-minute warning. Lynch added a 3-yard run and another swing pass to Lynch brought up third-and-3 at the San Francisco 48 with 1:18 left. Jackson was flushed from the pocket by Grant, who continued to pursue and grabbed Jackson from behind .The fumble bounced forward 10 yards, where Whitner fell on it as the San Francisco sideline burst into celebration.

Jackson finished 15 of 28 for 163 yards and a 13-yard TD pass to rookie Doug Baldwin in the first quarter.

Shelby church serves annual Christmas dinner

Inside, volunteers wearing red and white Santa caps scurried around tables and filled plates with piping hot food.?

Central United Methodist Church in Uptown Shelby has served a Christmas meal for the community?s hungry since 2007. This year, the volunteers nearly outnumbered the people they served.

?Most of the (volunteers) who are here today have been here before,? said Barbara Schafer, a Central United Methodist Church member.

Schafer said the expected to serve about 50 people Sunday at the church. Nearly 40 people volunteered their time on Christmas Day to serve the annual holiday meal. Many others helped by cooking and preparing food for the meal several days in advance.

People who ate during the Christmas meal also received a bag of toiletries and other necessities. Children received special gifts, too, Schafer said.

3 US citizens among victims in Mexico bus attack (AP)

PACHUCA, Mexico ? Three U.S. citizens traveling to spend the holidays with their relatives in Mexico were among those killed in a spree of shooting attacks on buses in northern Mexico, authorities from both countries said Friday.

A group of five gunmen attacked three buses in Mexico's Gulf coast state of Veracruz on Thursday, killing a total of seven passengers in what authorities said appeared to be a violent robbery spree.

The Americans killed were a mother and her two daughters who were returning to visit relatives in the region, known as the Huasteca, said an official in the neighboring state of Hidalgo, where the mother was born.

Hidalgo state regional assistant secretary Jorge Rocha identified the dead U.S. mother as Maria Sanchez Hernandez, 39, of Fort Worth, Texas, and the daughters as Karla, 19, and Cristina, 13. Rocha said all three held dual U.S.-Mexican citizenship. A 14-year-old Mexican nephew traveling with the three was also killed.

A U.S. Embassy official confirmed the women's nationalities, but could offer no information on their ages or hometowns. The official, who was not authorized to be quoted by name, said consular authorities were offering assistance to the victims' relatives.

While funeral plans were unclear, Rocha said Sanchez Hernandez's mother wants her daughter to be buried in Mexico.

Three other Mexican citizens were killed in the Thursday attacks on the three buses.

The five gunmen who allegedly carried out the attacks were later killed by soldiers.

Earlier in their spree, the gunmen shot to death three people and killed a fourth with grenade in the nearby town of El Higo, Veracruz.

On Thursday, the U.S. Consulate General in Matamoros, a Mexican border city north of where the attacks occurred, said in a statement that "several vehicles," including the buses, were attacked, but did not specify what the other vehicles were.

The consulate urged Americans to "exercise caution" when traveling in Veracruz, and "avoid intercity road travel at night."

While the specific area where the Thursday attacks occurred is not frequented by foreign travelers, other parts of the Huasteca ? a hilly, verdant area on the Gulf coast ? are popular among Mexican tourists and some foreigners.

The attack occurred near the border with the state of Tamaulipas, an area that has been the scene of bloody battles between the Zetas and Gulf drug cartels.

MyRobots.com: for all of your robot's social needs

You have your Facebook, Twitter, and some even MySpace. But what about your beloved cyborgs? They've got social needs too, you know. According to NewScientist, there's a new site on the block that'll allow your droids to have status updates of their own. Furthermore, MyRobots.com aims to be a complete social hub for humanoids; aside from the "I need to be charged" updates, they'll also secure a complete profile with name and photo. Of course, apps couldn't be left behind, which is why the company is planning a cloud-based app store to cap off its efforts. Unfortunately, just like The Facebook in its early days, the site is only open to a select few for now: Nao and Arduino-based robots. Needless to say, if you're going to have your mechanical partner make you a sandwich, the least you can do is let it share its feelings with friends.

Young Americans May Love Facebook, but Leave Mobile Payments to BanksThat is the conclusion of a new study from Market Strategies International, a market research company, we learn from American Banker and SourceMedia?s Kate Fitzgerald. Moreover, the ratio of young adults aged 18 ? 34 who said they trusted established financial institutions with their mobile payments was even greater than the one for any other age group.


What makes the survey?s results perhaps even more significant is that it was conducted in November, when the fury against the ill-conceived debit card fees that all big banks tried to introduce reached its climax. Let?s take a look at what Market Strategies found.

The fact that trust in technology companies as mobile payments providers is decreasing with age is hardly surprising, although I, for one, would have expected the Apples and Googles of the world to score somewhat better with young users on that front.


Similarly, the fact that the ?no preference? answer is also chosen more often by older consumers seems easy to explain. Younger Americans are much more active users of the products provided by technology companies and mobile carriers, while they use financial services just as often as older consumers, so they are much better positioned to qualify companies in each of these industries when it comes to providing a new type of service.


But why do they trust old-fashioned, stodgy banks with what is a new, cool technology more than they do the companies that are actually developing it? After all, Isis is a joint venture of three of the largest U.S. carriers, Google is now deploying its very own mobile wallet, all major makers of smart phones have either already launched, or will do so soon, an NFC-capable handset, and the list goes on.

Why Are Banks Trusted?


The Market Strategies researchers acknowledge the obvious, but don?t even attempt to explain why the much-maligned banks are trusted so much more with mobile payments than anyone else. Here is what Mark Willard, senior vice president and head of Market Strategies? financial services division had to say on the results of his study:

We tested the hypothesis that younger folks who are quick to adopt new technology and are willing to put their entire lives in Facebook trust these alternative providers more than they do banks, and found no support for that theory? In fact, younger consumers seem even more focused than other groups on getting mobile-payment services from their current bank.


OK, but why is that the case? Moreover, among financial institutions only big banks, whose reputation could hardly be any lower right now, have the resources to develop and deploy a mobile payments platform on a meaningful scale.


I won?t claim to have the complete answer here, but I think that at least a part of it should have something to do precisely with the fact that youngsters are so much more familiar with all potential m-payments providers than older folks are. Perhaps they intuitively trust each one of them to provide exclusively the types of services they specialize in. So Facebook is good at doing social media, Google at developing information-based technologies, Apple at making cool gadgets, and so on, but they should all stick to what they do best and leave the processing of payments to those who know how to handle them.

The Takeaway


Of course, there is an obvious flaw in my reasoning and we only need to look at how iTunes reinvented the music records industry and how the iPad is now doing the same with the newspaper business model to see how quickly outsiders can muscle into an established industry (or destroy it, for that matter).


On the other hand, and to take a more relevant example, Google Checkout failed miserably in its challenge to PayPal, even though the search giant didn?t exactly skimp in its financing of the project. But then PayPal is itself a company that managed to create a brand new payment processing model right under the noses of the big banks in the dot-com era. It seems to me that this is the example that today?s contenders (PayPal very much among them) should look at for inspiration.


Yet, young and old consumers alike are giving banks an early vote of confidence for managing their mobile payments. Whether or not banks will be able to exploit their advantage remains to be seen.

Arizona sheriff violates Latinos' civil rights, US says

Maricopa County, Ariz., Sheriff Joe Arpaio is accused by the Department of Justice of committing wide range of civil rights violations against Latinos.

The federal government issued a scathing report Thursday that outlines how Maricopa County Sheriff Joe Arpaio's office has committed a wide range of civil rights violations against Latinos, including a pattern of racial profiling and discrimination and carrying out heavy-handed immigration patrols based on racially charged citizen complaints.

The report, obtained by The Associated Press ahead of its release, is a result of the U.S. Justice Department's three-year investigation of Arpaio's office amid complaints of racial profiling and a culture of bias at the agency's top level.


The Justice Department's conclusions in the civil probe mark the federal government's harshest rebuke of a national political fixture who has risen to prominence for his immigration crackdowns and became coveted endorsement among candidates in the GOP presidential field. Apart from the civil rights probe, a federal grand jury also has been investigating Arpaio's office on criminal abuse-of-power allegations since at least December 2009 and is specifically examining the investigative work of the sheriff's anti-public corruption squad.

The civil rights report said federal authorities will continue to investigate complaints of deputies using excessive force against Latinos, whether the sheriff's office failed to provide adequately police services in Hispanic communities and a large number of sex-crimes cases that were assigned to the agency but weren't followed up on or investigated at all.

The report took the sheriff's office to task for launching immigration patrols, known as "sweeps," based on complaints that Latinos were merely gathering near a business without committing crimes. Federal authorities single out Arpaio himself and said his office, known as MCSO, has no clear policies to guard against the violations, even after he changed some of his top aides earlier this year.

"Arpaio's own actions have helped nurture MCSO's culture of bias," wrote Thomas Perez, who heads the Justice Department's civil rights division, adding that the sheriff frequently gave such racially charged letters to some of his top aides and saved them in his own files.

"MCSO is broken in a number of critical respects. The problems are deeply rooted in MCSO's culture," he said Thursday.

The Justice Department's expert on measuring racial profiling said it's the most egregious case of racial profiling in the nation that he has seen or reviewed in professional literature, Perez said.

Investigators interviewed more than 400 people, including Arpaio, reviewed thousands of documents and toured county jails as part of its probe, he said.

If the sheriff's office doesn't turn around its policies and practices, the federal government could pull millions of dollars of federal funding.

Arpaio's office did not immediately respond to AP requests for comment.

The report will require Arpaio to set up effective policies against discrimination, improve training and make other changes that would be monitored for compliance by a judge. Arpaio faces a Jan. 4 deadline for saying whether he wants to work out an agreement. If not, the federal government will sue him and let a judge decide the complaint.

Arpaio, the self-proclaimed toughest sheriff in America, has long denied the racial profiling allegation, saying people are stopped if deputies have probable cause to believe they have committed crimes and that deputies later find many of them are illegal immigrants.

Arpaio has built his reputation on jailing inmates in tents and dressing them in pink underwear, selling himself to voters as unceasingly tough on crime and pushing the bounds of how far local police can go to confront illegal immigration.

The report also said he and some top staffers tried to silence people who have spoken out against the sheriff's office by arresting people without cause, filing meritless lawsuits against opponents and starting investigations of critics.

One example cited by the Justice Department is former top Arpaio aide David Hendershott, who filed bar complaints against attorneys critical of the agency along with bringing judicial complaints against judges who were at odds with the sheriff. All complaints were dismissed.

The anti-corruption squad's cases against two county officials and a judge collapsed in court before going to trial and have been criticized by politicians at odds with the sheriff as trumped up. Arpaio has defended the investigations as a valid attempt at rooting out corruption in county government.

The civil rights report said Latinos are four to nine times more likely to be stopped in traffic stops in Maricopa County than non-Latinos and that the agency's immigration policies treat Latinos as if they are all in the country illegally. Deputies on the immigrant-smuggling squad stop and arrest Latino drivers without good cause, the investigation found.

A review done as part of the investigation found that 20 percent of traffic reports handled by Arpaio's immigrant-smuggling squad from March 2006 to March 2009 were stops ? almost all involving Latino drivers ? that were done without reasonable suspicion. The squad's stops rarely led to smuggling arrests.

Deputies are encouraged to make high-volume traffic stops in targeted locations. There were Latinos who were in the U.S. legally who were arrested or detained without cause during the sweeps, according to the report.

During the sweeps, deputies flood an area of a city ? in some cases, heavily Latino areas ? over several days to seek out traffic violators and arrest other offenders. Illegal immigrants accounted for 57 percent of the 1,500 people arrested in the 20 sweeps conducted by his office since January 2008, according to figures provided by Arpaio's office.

Police supervisors, including at least one smuggling-squad supervisor, often used county accounts to send emails that demeaned Latinos to fellow sheriff's managers, deputies and volunteers in the sheriff's posse. One such email had a photo of a mock driver's license for a fictional state called "Mexifornia."

The report said that the sheriff's office launched an immigration operation two weeks after the sheriff received a letter in August 2009 letter about a person's dismay over employees of a McDonald's in the Phoenix suburb of Sun City who didn't speak English. The tip laid out no criminal allegations. The sheriff wrote back to thank the writer "for the info," said he would look into it and forwarded it to a top aide with a note of "for our operation."

Federal investigators focused heavily on the language barriers in Arpaio's jails.

Latino inmates with limited English skills were punished for failing to understand commands in English by being put in solitary confinement for up to 23 hours a day or keeping prisoners locked down in their jail pods for as long as 72 hours without a trip to the canteen area or making nonlegal phone calls.

The report said some jail officers used racial slurs for Latinos when talking among themselves and speaking to inmates.

Detention officers refused to accept forms requesting basic daily services and reporting mistreatment when the documents were completed in Spanish and pressured Latinos with limited English skills to sign forms that implicate their legal rights without language assistance.

The Justice Department said it hadn't yet established a pattern of alleged wrongdoing by the sheriff's office in the three areas where they will continue to investigation: complaints of excessive force against Latinos, botched sex-crimes cases and immigration efforts that have hurt the agency's trust with the Hispanic community.

Federal authorities will continue to investigate whether the sheriff's office has limited the willingness of witnesses and victims to report crimes or talk to Arpaio's office.

"MCSO has done almost nothing to build such a relationship with Mariciopa County's Latino residents," Perez wrote.
